These terms and conditions of sale (the “Terms”) govern the distance sale of SAWA-branded items on the website sawa.site between the seller and any natural person acting for purposes outside their trade, business or profession (the “customer”).
The seller is MADIBA & MLK CONSULTING LTD, a private limited company incorporated under the laws of England and Wales, registered in England and Wales under company number 13238263, whose registered office is at 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London W1T 6EB, Royaume-Uni. Contact: contact@sawa.site.
The customer declares that they have the legal capacity to enter into a contract. The customer accepts the Terms by ticking the box provided for that purpose before payment. The applicable Terms are those in force on the date of the order; they can be saved or printed from this page.
Items (textiles, bags, water bottles, accessories) are made to order, after the order is placed, by our print-on-demand partners. Their main characteristics (material, dimensions, variants, care) are set out on each product page.
Product images are as accurate as possible. Colours may vary slightly depending on the screen and the printing process, and the placement of the print may be subject to a slight manufacturing tolerance. Such variations do not constitute a defect provided they remain minor.
Items are offered subject to availability at the production workshops. A variant that is unavailable cannot be ordered.
Prices are shown in euros, inclusive of all taxes where taxes apply. Delivery charges are calculated according to the items and the delivery address, and are displayed before payment together with the total amount payable.
Some items may be produced and shipped from a country outside the European Union. In that case, duties, taxes or customs clearance charges may be claimed on delivery by the carrier or by the authorities of the destination country; these are not included in the displayed price and are payable by the customer. The country from which each item is shipped will be provided on request before the order is placed.
The applicable price is the one displayed when the order is confirmed. The seller may change its prices at any time, without effect on orders that have already been paid for.
A promo code or partner code may be entered in the basket, limited to one code per order. Its conditions (amount of the discount, eligible items, minimum spend, dates and number of uses) are checked before payment; the discount is shown in the order summary, on the payment page and on the invoice. A code cannot be exchanged for cash. In the event of a partial refund, the discount remains allocated across the items kept.
To place an order, the customer:
The contract is concluded upon confirmation of payment. The customer receives an acknowledgement of receipt and an order confirmation by email, summarising the essential terms of the contract, together with their invoice in PDF format. The customer is then notified by email when the order is shipped, with parcel tracking where available. The seller keeps a record of the order for the period stated in the privacy policy; the customer may obtain a copy on request.
The seller may refuse or cancel an order in the event of a previous dispute with the customer, a serious suspicion of fraud, a delivery address that is not served, or unavailability arising after payment. Any sums paid are then refunded in full.
Payment is due when the order is placed. It is made by bank card or by the other methods offered on the payment page (for example Apple Pay or Google Pay), through the payment service provider Stripe. Card details are entered and processed directly by Stripe; the seller has no access to them. Payment may be subject to strong customer authentication (3-D Secure).
Items are delivered to addresses in the following countries: France métropolitaine, Belgique. Production begins after payment has been confirmed. As a guide, it generally takes 2 to 7 working days, plus the transit time, which depends on the workshop and the destination.
Unless another date is stated when the order is placed, items are delivered no later than thirty (30) days after the conclusion of the contract. If this period is exceeded, the customer may require the seller, in writing, to deliver within an additional reasonable period, and may then terminate the contract if delivery does not take place within that period; the customer is then refunded all sums paid within fourteen (14) days.
An order for several items may be delivered in several parcels. A tracking number is provided where available. The risk of loss or damage passes to the customer when the customer, or a third party designated by the customer, takes physical possession of the items. The customer is asked to report any missing, damaged or incomplete parcel as soon as possible, ideally with photos, so that it can be dealt with more quickly.
The customer has fourteen (14) days to withdraw from the contract, without giving any reason. This period runs from the day on which the customer, or a third party designated by the customer (other than the carrier), takes physical possession of the item. Where an order for several items is delivered separately, the period runs from receipt of the last item.
To exercise this right, the customer must inform the seller of their decision by an unequivocal statement, for example by email to contact@sawa.site, stating their order reference. The customer may use the model form at the end of these Terms, but this is not obligatory. It is sufficient for the notification to be sent before the withdrawal period has expired.
The customer must return the items, complete and in their original condition, without undue delay and no later than fourteen (14) days after communicating their decision, to the following address: 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London W1T 6EB, Royaume-Uni. The direct cost of returning the items is borne by the customer. The customer may be held liable for any diminished value of the items resulting from handling other than what is necessary to establish their nature, characteristics and functioning (for example, a garment that has been worn or washed).
The seller will refund all sums paid, including the initial delivery charges (up to the cost of the standard delivery method), no later than fourteen (14) days from notification of the withdrawal. The seller may withhold the refund until it has received the items back or until the customer has supplied evidence of having sent them, whichever is the earlier. The refund is made using the same means of payment as was used for the order, at no cost to the customer.
The seller is liable for any lack of conformity of the items under the conditions of Articles L. 217-1 et seq. of the French Consumer Code (France) and Articles 1649bis et seq. of the former Civil Code (Belgium), and for latent defects under the conditions of Articles 1641 to 1649 of the Civil Code. For any claim, contact contact@sawa.site with your order reference and, if possible, photos of the defect.
The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund upon returning the goods, if: (1) the trader refuses to repair or replace the goods; (2) the repair or replacement of the goods takes place after a period of thirty days; (3) the repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; (4) the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights set out above arise from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of its average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against latent defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.
Items that are defective, damaged in transit or different from what was ordered are replaced or refunded at no cost to the customer. No commercial guarantee is offered in addition to the legal guarantees.

These Terms are drafted in French; this English version is a translation. They are governed by English law, but this choice of law cannot deprive the customer of the protection afforded by the mandatory provisions of the law of the country in which they are habitually resident.
In the event of a problem, the customer is invited to contact the seller first in order to seek an amicable solution. Failing that, the customer may bring proceedings before the courts of their place of residence or any other court having jurisdiction under the applicable law.
